ABLE GALLERY SUBSCRIPTION AGREEMENT
PLEASE READ CAREFULLY. THIS SUBSCRIPTION AGREEMENT (THE “AGREEMENT”) IS A LEGALLY BINDING AGREEMENT BETWEEN YOU (“YOU” AND “YOUR”) AND GLOBAL ART GALLERY LLC, OPERATING AS ABLE GALLERY (“ABLE GALLERY,” “WE,” “US,” OR “OUR”). BY CLICKING THE “PROCESS TRANSACTION” BUTTON OR BY OTHERWISE COMPLETING THE SUBSCRIPTION REGISTRATION PROCESS, YOU ACKNOWLEDGE THAT YOU HAVE READ THIS SUBSCRIPTION AGREEMENT, UNDERSTAND IT, AND CONSENT TO BE BOUND BY ITS TERMS.
This Agreement is in addition to, and not in lieu of, the Able Gallery Terms of Use to which you agree when you initially use the site www.ablegallery.com (“Site”). By proceeding with the subscription, you reaffirm your consent to those Terms of Use. For purposes of this Agreement, “Activation Date” means the date on which Able Gallery first activates the subscription service(s) selected by you (“Subscription Services”).
ENROLLMENT IN THE SUBSCRIPTION SERVICES
You may subscribe to one or more of the following:
Able Gallery Basic: Single-user access to a 12-month database of traditional antique and art auction results. Includes email sharing and inquiry options with auctioneers.
Able Gallery Premium: Single-user access to a five-year historical database of traditional antique and art auction results. Includes sharing features and communication tools.
Able Gallery Professional: Full-access subscription to all historical auction results with unlimited browsing, sharing, and contact tools for auction houses.
Able Gallery Enthusiast: Single-user access to upcoming auction listings with 50 customized alert criteria and standard sharing/contact tools.
Able Gallery Dealer: Full-feature subscription for dealers, offering up to 500 customized alerts with real-time auction updates, advanced contact and research tools.
By subscribing, you confirm that you are authorized to use the payment method provided. If subscribing on behalf of a minor or third party, you accept full responsibility for compliance with this Agreement and associated charges.
TERM, FEES AND PAYMENTS
Initial Payment
Your subscription begins on the Activation Date upon payment of the applicable fee, which will be charged to your designated payment method.
Automatic Renewal
Subscriptions may be set to renew automatically at the end of each term. Unless otherwise stated during signup, monthly subscriptions will auto-renew. You will be notified via email at least 14 days in advance of any price increase prior to renewal.
Billing Date
Your billing date is based on the anniversary of your Activation Date. If the same day does not exist in the renewal month (e.g. February 30th), your billing date will adjust to the last valid calendar day of that month.
Upgrading
Upgrades are permitted. You may apply a pro-rated credit from your current subscription (excluding time earned via promotional offers). Upgrades take effect on the date of change.
No Refunds
All fees, including those for automatically renewed subscriptions, are nonrefundable. Subscriptions may be canceled at any time via your account settings on www.ablegallery.com.
Accepted Payment Methods
Able Gallery accepts VISA, MasterCard, American Express, and Discover. We do not accept checks, cash, or other methods. You are responsible for all unauthorized third-party charges to your card unless disputed within 60 days.
Late or Failed Payments
Accounts may be suspended without notice if payments are not received. You remain liable for any balance due following termination.
Taxes
You are responsible for any applicable taxes arising from your use of the subscription services.
Changes to Fees or Billing
We reserve the right to modify subscription fees and billing policies with 14 days’ notice sent to your registered email. Continued use of the service after this period constitutes your acceptance.
TERMINATION
By You
You may cancel your subscription at any time via your online account. Charges already incurred remain nonrefundable.
By Able Gallery
We may suspend or terminate your account at our discretion for violations of this Agreement or our Terms of Use. If terminated without cause, you may receive either a term extension or a pro-rated refund at our discretion.
CUSTOMER SUPPORT
Able Gallery is solely responsible for customer service. Neither your internet service provider, nor any auction house contributing data, nor any third-party access point is responsible for handling your account issues. Please contact Able Gallery support directly for billing or subscription assistance.
YOUR ACCOUNT INFORMATION
Accuracy and Maintenance
You agree to provide accurate information during registration and to keep your details current. You may update your account and payment information at any time through your dashboard on www.ablegallery.com.
Security
You are responsible for safeguarding your password and for all activity under your account. Notify us immediately at info@ablegallery.com if you believe your credentials have been compromised.
TECHNOLOGY NOTICE
We recommend using modern web browsers and operating systems for the best experience. While we strive for 24/7 availability, periodic outages may occur due to maintenance or unforeseen issues. Planned outages exceeding one hour will be communicated at least 24 hours in advance.
